NOTICE OF ARGUMENT BY VIDEO CONFERENCE

The above case is scheduled for oral argument by video conference as follows:

All oral arguments will be conducted on the Zoom video conference platform with a live stream to the Appeals Court's YouTube channel at https://www.youtube.com/channel/UC5m3QM1dmvSvc42I_9tTxtw?view_as=subscriber. The Clerk's Office has prepared a Guide to Zoom Arguments for attorneys and self-represented litigants that may be read online at https://www.mass.gov/guides/guide-on-the-use-of-video-conferencing-for-oral-argument-sessions or downloaded as a PDF.
Two business days before the argument, the Clerk's Office will email notice of the Zoom session and log-in credentials to those persons who have previously responded as appearing for an argument. The credentials must not be shared. Cases involving a self-represented person confined to an institution will proceed telephonically via the Zoom platform; the parties will participate by telephone with the Justices only appearing by video. For now, please note:
1. Response Required. You are required to respond in writing to identify the name of the attorney(s) or party who will argue the case. If you received this notice electronically, please respond by clicking on the reply button to provide the necessary information. If you received this notice by regular mail, please respond by sending an email identifying the case name, docket number, argument date, and the name of who is appearing, to AppealsCtClerk@appct.state.ma.us .
2. Staggered Appearances and Arguments. Oral argument is limited to FIFTEEN (15) minutes for each side. The Court will hold arguments based upon the sequence of the cases as appearing on the Court's calendar at https://www.ma-appellatecourts.org/calendar Attorneys or parties presenting argument must log in to the videoconference or teleconference 15 minutes prior to the following:
9:30 a.m. for case #1;
10:00 a.m. for case #2;
10:30 a.m. for case #3;
11:00 a.m. for case #4;
11:30 a.m. for case #5;
12:00 p.m. for case #6; and,
12:30 p.m. for any case #7.
3. Case Sequence Subject to Change. Please note that the sequence in which cases will be heard is subject to change. Please check the Court's above web calendar 48 hours prior to the date of argument to confirm the final schedule of cases.
4. Submission on the Brief. If you prefer not to participate at the oral argument and to submit your argument based on your brief, please file and serve a written notice at http://www.efilema.com for approval. If one party seeks to submit on the brief without argument, the Court prefers that all other parties to the case also submit on the brief, so please coordinate with any other party.
5. Subsequent filings in this appeal. All subsequent filings are required to be filed electronically at http://efilema.com Paper originals and copies are not accepted.
6. Notice of Change or Cancellation of Arguments. In the event of change or cancellation for any reason, the Court will send notice to counsel scheduled to appear, and will update the recording at 617-725-8114.
